SAN FRANCISCO—On Friday, October 11, the San Francisco District Attorney’s Office disclosed that a conviction was secured against Mitchell Hoyt, 34, after a trial by jury for breaking into an Upper Market Home and stealing an electric scooter while the residents were present. He was convicted of first-degree burglary (PC 459).
A press release from the SFDA’s Office indicated, according to evidence and other testimony presented at trial, on March 15, Hoyt scaled a fence leading to the backyard of a residential building on the 3700 block of Market Street, in broad daylight, where the victims lived. He jumped into the backyard patio and walked towards the victims’ garage on the first floor of the residence.
He entered the garage and stole a motorized scooter belonging to one of the residents before fleeing. The residents were all home as this transpired and two of them tried to chase Hoyt who was on the scooter, but he got away. The entire incident was captured on surveillance video. On April 16, an officer with the San Francisco Police Department spotted the defendant in the Fisherman’s Wharf area and arrested him.
“San Francisco residents deserve to feel secure in their homes and not have property stolen from them in broad daylight,” said Assistant District Attorney Angela Roze. “I would like to thank the jury for their careful consideration of the evidence and the law in this case, holding Mr. Hoyt accountable for his actions.”
Hoyt is currently in custody and his sentencing is scheduled for October 28.
